Terms of Service

By accessing or using Applaude ("the Service"), operated by Applaude AI LLC. ("we," "us," or "Company"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Applaude is an Answer Engine Optimization (AEO) platform that tracks brand visibility across AI-powered platforms including ChatGPT, Claude, Gemini, and Perplexity. These Terms are specifically tailored to govern the use of our AEO tracking, analysis, and reporting services.

Applaude provides AI visibility tracking services that include:

• Submitting recommendation-focused queries to AI platforms (ChatGPT, Claude, Gemini, Perplexity) via their official APIs
• Analyzing AI-generated responses for brand mentions, positioning, sentiment, and share of voice
• Generating visibility scores, competitive rankings, and optimization reports
• Delivering periodic tracking reports based on your selected frequency

The Service queries AI platforms using their publicly available APIs in compliance with each platform's terms of service. We do not scrape, reverse-engineer, or circumvent any platform's access controls.

To use the Service, you must create an account and provide accurate, complete information. You must be at least 18 years old and have the legal capacity to enter into these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

Applaude operates on a volume-based subscription model. Each subscription includes a defined number of tracking questions ("Question Lot") monitored at a selected frequency (weekly, bi-weekly, or monthly). Subscription fees are billed in advance on a recurring basis through Stripe. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' written notice. Price changes will apply to the next billing cycle following the notice period.

You agree not to:

• Use the Service to track brands you do not own or have authorization to monitor
• Submit questions designed to manipulate, spam, or abuse AI platform APIs
• Attempt to reverse-engineer our scoring algorithms, analysis methodology, or proprietary systems
• Resell, redistribute, or sublicense access to the Service or its outputs without written permission
• Use the Service for any unlawful purpose or in violation of any applicable regulations
• Interfere with the Service's infrastructure, security, or other users' access

All content, analysis, scoring methodologies, algorithms, and reports generated by Applaude are our intellectual property or licensed to us. You retain ownership of the data you input (brand names, tracking questions, key messages). We grant you a limited, non-exclusive, non-transferable license to use the reports and analysis generated for your business purposes, including: sharing reports internally and with your stakeholders via the sharing features we provide (shared links, PDF exports, email delivery, team seats); and, where your plan includes agency or white-label entitlements, presenting reports to and preparing them for your own clients. Reselling reports as a standalone product, or representing our analysis as your own methodology outside a white-label entitlement, is not permitted. AI-generated responses sourced from third-party platforms remain subject to those platforms' respective terms.

You retain all rights to your Customer Data, which includes your brand information, selected tracking questions, key messages, and competitor lists. You grant Applaude a limited license to use your Customer Data solely to provide the Service. We will not use your Customer Data to train AI models, sell to third parties, or for any purpose beyond delivering and improving the Service.

The Service is provided "as is" and "as available." We do not guarantee that AI platform responses will be accurate, complete, or consistent over time. AI models are updated by their respective providers and responses may change without notice. Visibility scores and rankings are based on our proprietary analysis methodology and represent our interpretation of AI platform outputs at a point in time. They should not be treated as definitive market research or investment advice.

To the maximum extent permitted by law, Applaude's total liability for any claims arising from the Service shall not exceed the fees paid by you during the twelve (12) months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

Applaude depends on third-party AI platform APIs (OpenAI, Anthropic, Google, Perplexity). We are not responsible for downtime, changes, or discontinuation of any third-party API. If an AI platform modifies its API access, pricing, or terms in a way that affects our ability to deliver the Service, we will notify you and may adjust the Service scope accordingly. We target 99.5% uptime for our platform but do not guarantee uninterrupted service.

You may cancel your subscription at any time through the billing dashboard without advance notice. Cancellation takes effect at the end of your current paid billing period, and your paid features remain available until then. Applaude may terminate the subscription with 30 days' written notice or suspend or terminate your account immediately if you violate these Terms. After your subscription ends, we retain your data in accordance with our Data Retention Policy. You may request data export before termination takes effect.

Any disputes arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in New York, New York. You agree to waive any right to participate in a class action lawsuit. Either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance.
